Doble given stay of adjudication in drug possession case

Erika Anna Doble, 45, Little Falls, was given a stay of adjudication in a third degree controlled substance possession charge in Morrison County District Court, Wednesday.

A felony fifth degree controlled substance possession charge and a gross misdemeanor child endangerment charge were dismissed.

The charges stemmed from a Jan. 19, 2016, incident of a search of Doble’s residence by agents of the Central Minnesota Violent offender Task Force, to look for an individual with a warrant, who was thought to be in the house. Doble allegedly gave consent to search for the individual.

While officers searched for the individual they noticed drug paraphernalia in plain view.

Agents were granted permission by Doble to search the property and found an electronic scale, a Band-Aid box with a baggie containing a substance that was tested to be methamphetamine, as well as a glass pipe containing white residue consistent with smoking meth during the search.

Agents noted that three children, ages 15, 14 and 2, lived in the residence.

The older children were Doble’s, while the 2-year-old belonged to another woman, who was present at the time of the search, and admitted to officers that she had lived in the residence for several months.

The woman also allegedly admitted to smoking meth.

Doble pleaded guilty to the third degree felony drug possession charge as part of a plea agreement.

Doble was sentenced to 21 days in jail, and was approved for the Sentence to Serve program, as well as work release. She was also sentenced to five years of supervised probation and was  fined $50.

 


Dewitt faces charges for allegedly receiving stolen ATV

Micheal John Dewitt, 19, Little Falls, has been charged in Morrison County District Court with a felony for receiving stolen property.

On Oct. 10, 2016, a woman called authorities and told them her boyfriend’s four-wheeler was stolen.

According to the criminal complaint, she said she believed Dewitt stole the vehicle, because he had allegedly asked about the four-wheeler on several occasions.

According to the criminal complaint, a relative of Dewitt’s told the woman Dewitt had told him he had stolen the four-wheeler and planned to sell it in St.Cloud.

The woman called Dewitt, and told him to return the vehicle or she would turn him into the police.

Dewitt allegedly returned the vehicle, but according to the criminal complaint, it was missing a saddlebag and stickers.

Police also spoke with a man who Dewitt lives with, who allegedly said Dewitt had taken his truck, without his permission, which was damaged the next time he went to use it.

The truck owner said his surveillance video allegedly showed that Dewitt and two other individuals took his keys.

According to the criminal complaint, Dewitt told the truck owner he had taken it to St. Cloud.

Allegedly, there were stickers from the four-wheeler, as well as a shirt the  four-wheeler’s owner had said was missing from his saddlebags.

If convicted of the felony charge, Dewitt faces up to five years in prison and/or a $10,000 fine.

He was also charged with a misdemeanor for tampering with a motor vehicle, without the owner’s permission.

Girtz charged with making terroristic threats to police

Jeremy Thad Girtz, 49, Randall, is facing a felony charge for allegedly making terroristic threats to police.

On Dec. 25, 2016, Girtz called the police, and allegedly told dispatchers he wanted police to kill him and made other comments indicating he was suicidal.

Deputies found Girtz outside his residence. A deputy told Girtz to come with him so he could make sure he was OK.

According to the criminal complaint, Girtz then took out a metal object, told the deputy it was a handgun, pointed it at the officer and told him he was going to kill the officer.

Deputies were unable to determine what the object was from the distance between them and Girtz.

He allegedly flanked the officers, so they no longer had cover.

At that point, an officer shot Girtz with a less lethal shotgun round in the thigh.

When law enforcement handcuffed Girtz and asked if he had a gun, Girtz allegedly said he had a pair of vice grips and kept asking why officers didn’t kill him.

Girtz also allegedly told said he had a chemical dependency problem and that he needed to be committed otherwise he would continue to try to have law enforcement kill him.

A pair of vice grips, held to make the handle look like the barrel of a gun, was  allegedly found on Girtz.

If convicted, Girtz faces up to five years in prison and/or a $10,000 fine.

  • Joshua Michael Nelson, 25, Little Falls; (offense: 5/28/2016) second degree DWI, fined $165, sentenced to 30 days in jail and supervised probation for four years. Dismissed against Nelson was one gross misdemeanor count of third degree DWI.
  • Tena Lee Huff, 46, Motley; (offense: 9/1/2016)  third degree DWI, fined $610, sentenced to 30 days in jail and supervised probation for four years. Dismissed against Huff was one gross misdemeanor count of third degree DWI.

 

Misdemeanors

  • Amanda Jo Hansen, 29, Minneapolis; (offense: 11/8/2016) domestic assault, fined $135, supervised probation or two years.
  • Michael Raymond Patton, 39, Little Falls; (offense: 11/7/2015)  domestic abuse, fined $135, sentenced to 19 days in jail and supervised probation for one year.
  • Joshua Paul Wozniak, 24, Little Falls; (offense: 9/21/2016) damage to property, fined $135, probation to the court for one year.
  • Daniel Owen Crocker, 58, Motley; (offense: 10/21/2016) DWI, fined $285, sentenced to one days in jail and probation for the court for one year.
  • Zachary James Kretsch, 19, Little Falls; (offense: 5/20/2016) fleeing a peace officer, fined $100, probation to the court for one year.

•             Matthew Richard Ratliff, 34, Fort Ripley; (offense: 6/6/2016) fourth degree DWI, fined  $485, sentenced to two days in jail and supervised probation for two years. Dismissed against Ratliff was one gross misdemeanor of third degree DWI.

Brandon Middendorf charged with burglary

Brandon Lee Middendorf, 32, Pierz, is facing a felony third degree burglary charge for allegedly stealing floor jacks, a battery charger and more from a garage on Highway 27 between Little Falls and Pierz.

A homeowner called the Morrison County Sheriff’s Office Monday, Dec. 19, about 11:23 a.m., reporting their home had been burglarized and several items missing.

Deputies found footprints in the snow leading to another residence, where they found Middendorf, along with evidence allegedly linking him to the burglary.

According to the criminal complaint, Middendorf’s boot treads matched those around the garage.

Deputies located several of the missing items at two different pawn shops in St. Cloud.

Middendorf was arrested and during questioning, allegedly admitted he was involved in the burglary.

If convicted, Middendorf faces up to five years in prison and/or a $10,000 fine.

Demo sentenced for criminal sexual conduct

Cody Allyn Demo, 24, Pierz, was convicted Dec. 21, 2016, of felony third degree criminal sexual contact with a victim 13-15 and actor 24 months older.

The charge stems from a May 2016 report from the victim’s mother, who found out that her daughter was sexually assaulted by Demo on or about March 25, 2016.

The victim’s mother was provided with information that Demo’s phone contained photos of her daughter. When she questioned her daughter, the daughter admitted that Demo had sexually assaulted her.

Investigators spoke with the victim, who detailed the sexual assault, in which Demo also told the victim to stay quiet about the incident.

Demo was sentenced to 51 months in prison, to be served concurrently with another sentence.

Backus woman charged with meth possession

Sheila Diane Kruckow, 60, Backus is facing a felony fifth degree controlled substance possession charge.

On Dec. 22, 2016, a State Trooper stopped Kruckow’s vehicle which contained her and a driver who has not been charged with a felony, for allegedly going 77 mph in a 65 mph zone on Highway 371.

According to the criminal complaint, the trooper noticed the smell of marijuana, as well as a canister of butane fuel and a cable lock box, in plain sight between the seats.

The trooper also saw a bag allegedly containing a clear powder.

According to the criminal complaint, after a conversation, Kruckow let law enforcement search the locked box.

It allegedly contained marijuana and 4.77 grams of what field tested positive as methamphetamine.

Kruckow allegedly said the box was hers.

If convicted, Kruckow faces up to five years in prison and/or a $10,000 fine.

Fergeson Jr. charged with registration violation

Dan Leroy Fergeson Jr., 24, whereabouts unknown, is facing a felony charge for violating predatory offender registration requirements.

Fergeson has been required to register as a predatory offender since 2014, following felony theft convictions.

Fergeson was required to register for 10 years and inform authorities at least five days in advance of moving.

On Oct. 30, 2016, law enforcement went to perform a compliance check on Fergeson at his Little Falls residence.

The property owner allegedly told officers Fergeson had was gone and hadn’t been at the home for a while.

According to the criminal complaint, the homeowner said he believes Fergeson was now living in Colorado.

If convicted, Fergeson faces up to five years in prison and/or a $10,000 fine.

Dec. 22 — A resident on Lakewood Drive in Randall reported a scam in which someone called claiming to be the resident’s grandchild, but hung up when the resident asked a question the caller could not answer.

Dec. 24 — A resident on Highway 27 in Pierz reported a burglary.

Dec. 27 — A resident on 230th Street in Randall reported the theft of two jewelry boxes from under their bed. One box was an 18-by-12-inch brown box and one an 8-by-6-inch box. The boxes contained jewelry valued at $200.

Backus man charged with felony first degree burglary

Lee Adam Morcomb, 30, Backus, is facing first and second degree felony burglary charges.

Around 10 p.m. on Dec. 18, 2016, the Motley Police Department was sent to investigate a burglary at an apartment building in Motley.

According to the criminal complaint, a large number of quarters had been stolen from the laundry room.

According to the criminal complaint, a witness told police two people were in the laundry room, one of whom was blocking the door, before leaving with a gray duffel bag.

A white pickup truck that had been at the apartment building earlier that evening returned after the incident. A person from the apartment allegedly approached the truck and it left.

According to the criminal complaint, police stopped the truck as it left the parking lot and identified the driver as Morcomb.

He allegedly told law enforcement he was on probation for breaking into laundry machines in Morrison County, but denied stealing from the machines in Motley.

Morcomb allegedly eventually said he broke into the machines.

When they looked into the van, officers allegedly found a large number of quarters, a panel the criminal complaint said came from the apartment’s washing machine and a gray duffel bag.

After obtaining a search warrant, officers found more quarters in the duffel bag.

If convicted of both charges, Morcomb faces up to 30 years in prison and/or $55,000 in fines.

St. Paul man convicted of felony domestic assault

Christopher Lee Cannon, 28, St. Paul, was convicted of felony domestic assault in Morrison County District Court, Dec. 28, 2016. A felony domestic assault by strangulation charge was dismissed.

On Sept. 23, 2016, an officer with the Little Falls Police Department responded to a domestic dispute.

According to the criminal complaint, the victim stated her husband, Cannon, who she hadn’t seen for more than a month, arrived at her place of work before returning with her to her residence for dinner and a movie.

Later, Cannon saw something on the victim’s phone he didn’t like and attacked her, attempting to choke her with a belt and a cord, the victim said.

He also said he would bury her under the home.

Court documents say there were a few marks on the victim’s neck.

Officers found Cannon, who had fled on foot, near the Little Falls High School.

Cannon was arrested for domestic assault and a warrant out of Hennepin County.

Assistant County Attorney Amber Kusler said the felony domestic assault by strangulation charge was dismissed because Cannon didn’t impede the victim’s  breathing.

Cannon was sentenced to 39 months in prison and was fined $135.

Cannon was also convicted of a misdemeanor for fleeing an officer by means other than a motor vehicle.

Johnson convicted of receiving stolen property

Walter Russell Johnson, 52, Little Falls, was convicted in Morrison County District Court, Dec. 28, 2016, on a felony receiving stolen property charge.

On Oct. 7, 2016,  the Little Falls Police Department responded to a report of a stolen vehicle.

The victim identified Johnson as a possible suspect due to a previous relationship between the two.

Johnson originally told the victim he  didn’t know where the vehicle was, but later showed her  the vehicle was parked at an apartment building in Little Falls.

The vehicle was located where Johnson said it was and the victim had never said he could take it.

When police arrested Johnson, he said someone else had taken the vehicle.

The keys to the vehicle were in Johnson’s possession.

Johnson was sentenced to 90 days in jail and was given credit for serving 60 days.

Johnson was also sentenced to 13 months in prison, but was given  a stay with 10 years of probation. He was fined $185.

Princeton man given stay in felony terroristic threat case

Bruce Duane Anderson, 59, Princeton, was given a stay of adjudication in Morrison County District Court Wednesday, for a felony terroristic threats charge.

The charges stem from a May 24, 2016, incident in which a victim reported being threatened by Anderson.

The victim stated that Anderson threatened him after he did not like a furnace that the victim sold him, which was installed by a subcontractor.

According to the victim, Anderson said that he was “a dead man walking,” and that “your kids will be watching you take your last breath.”

Anderson admitted to threatening the victim, but only threatened to beat him up.

The victim said he was worried for his family.                      Anderson was sentenced to two days in jail, and must complete 40 hours of community service. He was also given 10 years of supervised probation and was fined $100.

A gross misdemeanor charge for stalking with the intent to injure was dismissed.

Stanley charged with making terroristic threats

James Joseph Stanley, 37, Little Falls, is facing a felony terroristic threat charge.

On Dec. 24, 2016, around 6 a.m., officers from the Little Falls Police Department were dispatched to an apartment in downtown Little Falls where Stanley was allegedly screaming and yelling on a balcony.

When the officers arrived, they found Stanley on the balcony, allegedly holding something that looked like a handgun.

According to the criminal complaint, officers asked Stanley to put the gun down, but he didn’t comply.

Stanley allegedly said he was going to kill himself and was moving quickly.

According to the criminal complaint, one of the officers was able to convince Stanley to put the gun down by offering him a cigarette.

Stanley allegedly appeared impaired and said he had been using methamphetamine.

According to the criminal complaint, the object Stanley had was an airsoft replica.

If convicted, Stanley faces up to one year and a day in jail and/or a $3,000 fine.


Lease charged with third degree criminal sexual conduct

Joseph Allen Lease, 19, Little Falls, is facing a third degree criminal sexual conduct charge for allegedly having sex with a victim between 13-15 years old, while he is at least two years older.

On Sept. 14, 2016, the Little Falls Police Department received a report of a 14-year-old child having sex with an adult.

According to the criminal complaint, the teenager and Lease had sex at a home in Little Falls in April 2016, when Lease would have been over 18 years old.

Both the teenager and her father said the father had specifically told Lease she was 14 years old.

When investigators spoke with Lease, he allegedly said he thought the girl had been 16 and that it was OK.

If convicted, Lease faces up to 15 years in prison and/or a 30,000 fine.

Bartkowitz faces rendition to Wisconsin for drug charge

Robert Donald Bartkowitz, 47, Little Falls, is facing rendition to Wisconsin for allegedly possessing methamphetamine.

On Dec. 16, 2016, law enforcement stopped Bartkowitz’s vehicle for an alleged equipment violation.

The officer noticed there was a warrant out for Bartkowitz’s arrest, and Wisconsin law enforcement alleges he left their supervision.

Bartkowitz was placed under arrest and taken to the Morrison County Jail.

Bartkowitz allegedly said he was the person listed on the warrant and said he wouldn’t fight extradition.

Dahl charged with felony for escaping from custody

Ashley Ann Dahl, 27, Little Falls, is facing a felony for allegedly escaping from custody.

According to the criminal complaint, following a violation of her probation for fleeing the police in a motor vehicle, Dahl was sentenced to 90 days in jail.

Court documents say she was granted temporary leave for treatment on Oct. 24, 2016, but agreed to return to jail within two hours if discharged unsuccessfully.

On Nov. 29, 2016, Community Corrections notified the court that Dahl had failed treatment the previous day.

Dahl had allegedly not returned to jail by that time., as agreed to in court.

If convicted, Dahl faces up to five years in prison and/or a $10,000 fine.

Gross misdemeanor charges filed- 01/08/17

Morrison County Attorney Brian Middendorf and his staff have filed gross misdemeanor complaints against the following people:

  • Richard Allen Bate, 30, Little Falls — In connection with a Dec. 30 incident, Bate has been charged with one count of fifth degree controlled substance crime – possession and one count of giving peace officer false name/birth date/ID card.
  • Joseph Michael Passon, 32, Sauk Rapids — In connection with a Dec. 24 incident, Passon has been charged with one count of theft – value more than $500 but less than $1,000.
  • Douglas Floyd Keinholz, 66, Burtrum — In connection with a Nov. 25 and Dec. 5 incident, Keinholz has been charged with two  gross midemeanor counts of domestic abuse – violate order for protection.

If found guilty, they could face a maximum penalty of one year in jail and/or a $3,000 fine.

The court will set their appearance date

Elderly couple injured in one-vehicle accident

An elderly Detroit Lakes couple was injured Saturday, Jan. 7, on Highway 10, just south of the Highway 27 exit in Little Falls, about 2:47 p.m.

The Morrison County Sheriff’s Office said Cheryl Kluender, 70, was driving a Cadillac SUV north on Highway 10, when she allegedly fell asleep, left the roadway and struck a tree. She and her passenger, Howard Kluender, 73, also of Detroit Lakes, were transported by ambulance to St. Gabriel’s Hospital in Little Falls, with unknown injuries.

The Sheriff’s Department was assisted by the Little Falls Police Department and Gold Cross Ambulance.
