Gross misdemeanor charges filed- 12/11/16

Morrison County Attorney Brian Middendorf and his staff have filed gross misdemeanor complaints against the following people:

  • Bryce Charles Euteneuer, 19, Little Falls — In connection with a Aug. 12 incident, Euteneuer has been charged with one count of offer a forged check – less than $250.
  • Steven John McMahan, 26, Little Falls — In connection with a Nov. 30 incident, McMahan has been charged with one count of stalking – follow, monitor, pursues another.
  • Fred Scott Siegel, 54, Randall — In connection with a Dec. 4 incident, Siegel has been charged with one count of emergency telephone calls/communications, interrupt, interfere, impede, disrupt 911 call and one count of domestic assault.
  • Nicholas Raymond Krueger, Pierz — In connection with a Dec. 1 incident, Krueger has been charged with giving peace officer false name of another person and one count of theft – value more than $500 but less than $1,000.

If found guilty, they could face a maximum penalty of one year in jail and/or a $3,000 fine. The court will set their appearance date.

Brickey charged with multiple felonies

Craig Van Brickey, 36, Little Falls, was charged Monday with felony second degree assault with a dangerous weapon and terroristic threats. He was also charged with a gross misdemeanor for obstructing the legal process with force.

On Dec. 11, law enforcement responded to a report of an assault at a Little Falls bar.

When police arrived they spoke to a man who said he had been attacked by a man the criminal complaint identifies as Brickey.

According to the criminal complaint, the victim had let Brickey sit in his truck since it was cold out. Brickey and the man allegedly had polite conversation, before Brickey allegedly began making racial slurs and white supremacist comments,

The victim then attempted to make Brickey leave the truck and both fell out as they allegedly fought one another.

According to the criminal complaint, after being told to leave, Brickey took out a folding knife and asked if the victim wanted to fight.

The victim was allegedly able to calm Brickey down and he went into the bar.

Police detained Brickey as he was standing in the parking lot without his shirt, with a bloody nose and allegedly drunk.

Once in the back of the squad car, Brickey was allegedly yelling and hitting his head on the inside of the car.

Brickey also allegedly held onto the door so the officer was unable to open it, before being overpowered and placed under arrest.

At the Morrison County Jail, Brickey allegedly threatened to kill the officer.

If convicted of the two felonies, Brickey could face up to 12 years in prison and/or $24,000 in fines.

 

Perham man convicted of felony possession

Larry Burian McClendon Jr., 46, Perham, was convicted of felony fifth degree controlled substance possession in Morrison County District Court, Dec. 9.

Around 12:45 a.m. on Oct. 12, a Minnesota State Patrol Officer stopped a SUV in Little Falls with no license plates on it.

A North Dakota 30-day registration permit dated Aug. 1, was taped to the SUV’s window.

The patrolman identified the driver as McClendon Jr., and found his license was canceled and that there were warrants out for his arrest.

When McClendon was placed under arrest and searched, a chewing tobacco can was found. McClendon said there was methamphetamine in it.

A small plastic baggie with a powder that field-tested positive as meth was found in the can.

Once the two passengers had exited the vehicle, law enforcement searched it and found two meth pipes and a baggie of meth in the center console. McClendon said one of the pipes was his.

Marijuana and a paper envelope containing $1,725 in cash were found in the second row seat.

McClendon was sentenced to 180 days in jail, and received credit for 16 days served. During local confinement, he was granted work release and is part of the Sentence to Serve (STS) program.

McClendon was also sentenced to 19 months in prison, but was given a stay for five years of supervised probation.

He was fined $135.

A gross misdemeanor charge for driving without a license was dismissed.

Gross Misdemeanors

  • James Earl Wunderlich, 37, Burtrum; (offense: 8/6/2016) dismissed against Wunderlich was one gross misdemeanor count of driving after cancellation.
  • Sherri Lee Nurnberger, 53, Little Falls; (offense: 1/22/2016)harassment, restraining order – violate within 10 years of first of two previous domestic violence convictions, fined $135, sentenced to 11 days in jail and supervised probation for two years and one misdemeanor count of DWI.

 

Misdemeanors

  • Brendon Lee Haglund, 29, Brainerd; (offense: 2/6/2016) disorderly conduct – offensive/abusive/noisy/obscene, fined $135, sentenced to four days in jail and supervised probation for one year.  Dismissed against Haglund was one gross misdemeanor count of domestic assault.
  • Gage James Gangl-Leyk, 20, St. Cloud; (offense: 8/27/2016) DWI, fined $560, sentenced to one day in jail and supervised probation for two years.

Pierz man arrested in connection with a home burglary between Pierz and Little Falls

Charges are pending against a Pierz man for his alleged involvement in a burglary at a home on Highway 27, between Little Falls and Pierz.

A homeowner called the Morrison County Sheriff’s Office Monday, Dec. 19, about 11:23 a.m., reporting their home had been burglarized and several items missing. Deputies found footprints in the snow leading to another residence, where they found Brandon Middendorf, along with evidence allegedly linking him to the burglary.

Deputies located several of the missing items at two different pawn shops in St. Cloud.

Middendorf was arrested and during questioning, allegedly admitted he was involved in the burglary. He is being held in the Morrison County Jail, pending formal charges.


Reward increases to $30,000 for information leading to Terry Brisk’s killer

Morrison County Sheriff Shawn Larsen said the reward for information that leads to the identification of the person who shot and killed Terrence (Terry) Brisk Nov. 7, has been increased to $30,000. Larsen said other donors have come forward and wish to remain anonymous.

The Morrison County Sheriff’s Office is still asking for the public’s assistance in locating a Winchester Model AE 30-30 lever action rifle belonging to Brisk, 41, who went out hunting on family-owned land in Belle Prairie Township, east of Little Falls.  The rifle is described as an older model, with a wooden stock and forearm with no sling attached.  Brisk was known to carry the rifle in the woods while hunting and at this point in the investigation it has not been located.

The Sheriff’s Office continues to actively investigate this case along with the assistance of the Bureau of Criminal Apprehension (BCA).

All information relevant to the case is being followed up on and numerous interviews are being conducted.  No arrests have been made up to this date.  Larsen still believes this is an isolated incident and there is no known risk to the public.

Wimmer charged with two drug possession felonies

Crystal May Wimmer, 31, Little Falls, is facing felony third and fifth degree drug possession charges in Morrison County District Court.

On Oct. 14, a Morrison County Sheriff’s deputy responded to a report of a suspicious vehicle parked at a park near Little Falls.

When he located the vehicle, the deputy allegedly noticed a strong scent of marijuana and asked the two occupants, a driver and Wimmer, to hand over any controlled substances.

Wimmer allegedly said there may be marijuana in her purse. When the deputy searched the purse, he found four pills allegedly identified as Vicodin, a schedule III controlled substance and a pill that allegedly was identified as Percocet, a schedule II controlled substance.

Wimmer allegedly said she didn’t have a valid prescription for the drugs and got them from a friend.

The deputy also found an aspirin container, allegedly containing 10 Vicodin pills and 10 Percocet pills.

The third degree possession charge comes from Wimmer allegedly possessing the schedule II drugs in a park.

If convicted of both felonies, Wimmer could face up to 25 years in prison and/or $260,000 in fines.

Hastings man charged with receiving stolen property

Alex Mathew Lafountaine, 20, Hastings, was charged in Morrison County District Court, Dec. 9, with a felony for allegedly possessing a stolen van.

On Dec. 9, law enforcement responded to a report of an assault in Little Falls.

At the location of the assault, officers saw a vehicle that was parked, running and had one headlight on.

According to the criminal complaint, the driver was sitting in the driver’s seat before suddenly slumping down.

The officers ran the license plate number and the vehicle allegedly came back as being stolen from Hastings.

Law enforcement escorted the driver, who allegedly identified himself as Lafountaine, out of the vehicle and placed him under arrest.

According to the criminal complaint, dispatch and an officer from Hastings confirmed the vehicle was stolen.

When a photo of the registered owner was brought up, Lafountaine allegedly said that the person was his neighbor and that he had used his van.

Lafountaine was then taken to the Morrison County Jail.

If convicted, he faces up to five years in prison and/or a $10,000 fine.

Onamia woman charged with stealing from car

Ardana Jo Beaulieu, 48, Onamia, is facing a felony theft charge for allegedly stealing over $2,000 worth of stuff from a car parked at a Morrison County business.

On July 26, the Morrison County Sheriff’s Office received a report of items being stolen from a car parked at an auto service shop near Hillman.

According to the criminal complaint, when deputies spoke with the car’s owner, he told them Beaulieu had come to the station wanting to take the tires off the vehicle because it was her step-father’s former vehicle. The car’s owner refused, saying he owned the car now.

Surveillance video from July 23, allegedly shows Beaulieu and several unidentified persons stealing items from the vehicle, before placing the items, in a car allegedly belonging to Beaulieu.

According to the criminal complaint, Beaulieu has not responded to law enforcement’s attempts to contact her.

If convicted, Beaulieu faces up to five years in prison and/or a $10,000 fine.

Predatory offender charged with violating registration

Steven David Fuchs, 29, whereabouts unknown, is facing a felony charge for allegedly violating requirements that he notify law enforcement before moving.

In 2010, Fuchs was required to register as a predatory offender. He is required to notify the state of his primary address at all times and give five days’ notice before moving.

On Oct. 30, a Morrison County Sheriff’s Deputy went to Fuchs’ last known address, located in Little Falls Township, for a compliance check.

When a person answered the door for the deputy, she allegedly said Fuchs did not live there and hadn’t been at the home since Sept. 1.

According to the criminal complaint, she said Fuchs had only stayed at the home for two days before leaving Sept. 1.

She said she didn’t know where Fuchs was.

Because his whereabouts are unknown, the state requested that a warrant for his arrest be issued.

As of publication, Fuchs’ location is still unknown.

If convicted, he faces up to five years in prison and/or a $10,000 fine.

  • Sherri Lee Nurnberger, 53, Little Falls; (offense 1/22/16) harassment, violating a restraining order, and a misdemeanor DWI, sentenced to 11 days in jail and two years of supervised probation and fined $135.

  • Richard John Geise, 29, Pierz — In connection with a Sept. 24 incident, Geise has been charged with two counts of third degree DWI.
  • Carolyn Ethel Engholm, 60, Little Falls — In connection with a Dec. 14 incident, Engholm has been charged with one count of second degree DWI and one count of third degree DWI.                            •             Israel (NMN) Martinez Ramirez, 22, Royalton — In connection with an Aug. 13 incident, Martinez has been charged with two counts of third degree DWI.
  • Bradley Thomas Zimmerman, 26, Little Falls — In connection with a May 22 incident, Zimmerman has been charged with two counts of second degree DWI.
  • Tanner Lee Nunn, 25, Pierz — In connection with an Aug. 20 incident, Nunn has been charged with two counts of third degree DWI.

If found guilty, they could face a maximum penalty of one year in jail and/or a $3,000 fine.

The court will set their appearance date.


Felony drug possession charge in Pfau case dismissed in district court

A felony fifth degree drug possession charge against Austin Michael Pfau, 29, St. Cloud, was dismissed in Morrison County District Court, Nov. 17.

A misdemeanor charge for driving after his license was suspended dismissed Monday.

The charges stemmed from a July 7 incident in which a deputy of the Morrison County Sheriff’s Office observed a car pull into a gas station and his system told him that the vehicle’s owner did not have a license.

The deputy observed that the driver appeared to match the description of the car’s owner, Pfau.

The officer then conducted a traffic stop, confirmed the driver as Pfau and placed him under arrest for driving after suspension.

In conjunction with the arrest, the officer searched the vehicle, and allegedly found a glass pipe and methamphetamine.

Assistant County Attorney Mike Chisum said the judge dismissed the case following a contested omnibus hearing.

A contested omnibus hearing happens when the prosecution and the defense argue over what evidence is admissible in court. In this case the judge ruled in favor of the defense, deeming evidence inadmissible.

Nightingale convicted of receiving stolen property

Brian James Nightingale, 27, St. Cloud, was convicted Dec. 15, of a felony for receiving stolen property in Morrison County District Court, Dec. 15.

On Sept. 3, a Morrison County Sheriff’s deputy pulled a vehicle over on Highway 27, for having no front license plate.

The driver said he was Zachary Nightingale.

However, the license plate came back as stolen out of St. Cloud. Law enforcement from St. Cloud advised the deputy the driver was likely Brian Nightingale.

The deputy identified Nightingale using his driver’s license photo, and Nightingale admitted who he was and that the vehicle was stolen.

In the purse of another person in the car, deputies found the title to the stolen vehicle.

Nightingale was sentenced to 105 days in jail, and received credit for 105 days served.

He was also sentenced to five years of supervised probation and fined $2,979.25, including $2,844.25 in restitution to the victim.

Wisconsin man in critical condition after Christmas Day accident

A man from Holmen, Wis. Is in critical condition after he lost control of his vehicle on an icy patch on Highway 10, north of Cushing.

The Morrison County Sheriff‘s Office said they received the report of a one-vehicle accident with injuries Sunday, Dec. 26, at approximately 12:59 p.m. The accident was on  Highway 10 in Scandia Valley Township, north of Cushing.

The Sheriff’s Office said Adam McCullough, 26, was traveling north on Highway 10 when he lost control on the icy road. McCullough’s vehicle left the roadway and rolled into the median. McCullough was the only occupant and was seat belted.  He was transported to by Gold Cross Ambulance to St Gabriel’s Hospital and then transferred to St. Cloud Hospital.  McCullough was later airlifted to North Memorial Medical Center in Robbinsdale and is in critical condition.

The sheriff’s office was assisted on scene by Scandia Valley Fire Department, Scandia Valley First Response Team and Gold Cross Ambulance.
