Cody Allen Mayer, 24, Cushing, was convicted of fifth degree possession of methamphetamine May 18.
Mayer pleaded guilty to both the felony drug charge and to a misdemeanor domestic assault charge.
According to the criminal complaint, in August 2015, a victim called Morrison County law enforcement to report that she had been assaulted by Mayer.
The victim said that Mayer lived with her and is a family member.
The victim arrived home with her mother, heard a loud slam of a door and found Mayer to be upset for some reason.
Mayer began yelling at the victim, grabbed her by the wrists and also put his arm around her neck and began choking her.
Law enforcement observed red marks on both the victim’s wrists and her neck and chest area.
Mayer was located inside the residence and admitted he had argued with the victim but denied touching her.
The victim also showed law enforcement Mayer’s living space in the residence, in which drug paraphernalia was observed in plain view.
Law enforcement found a meth pipe and a marijuana pipe as well as two clear plastic baggies, one of which contained a small amount of a white powdery substance that appeared to be meth.
Mayer was given a stay of imposition and sentenced to 10 years probation and $185  in fines.
As part of his probation, Mayer can’t have alcohol or controlled substances and  must complete a domestic abuse evaluation. If Mayer fails to meet his probation requirements he faces 13 months in prison.
