Roger Alan Majaski, 37, Bowlus, was charged Feb. 3 with one felony count of domestic assault by strangulation, as well as one gross misdemeanor count each of domestic assault and malicious punishment of a child.
According to the criminal complaint, on Feb. 1, an employee of Social Services received a report of child abuse. Law enforcement went to the elementary school and spoke with the victim, who alleged that he lives with his mother and Majaski.
The victim stated that his mother and Majaski went to the bar for several hours on or about Jan. 31.
When they arrived home, Majaski was allegedly very upset because the victim was still awake and had left the light on in the garage.
The victim said Majaski grabbed him around the neck with both arms and squeezed, preventing the victim from breathing.
The victim indicated that he was scared. The victim’s mother allegedly intervened to get Majaski to stop.
Officers observed bruising around the victim’s neck and eyes.
Majaski allegedly admitted that he had been out drinking that night and came home at about 1 a.m.
He said he was angry that the victim was still awake and allegedly admitted he grabbed the victim.
Majaski allegedly denied putting the victim in a chokehold, but said it was possible he left marks on the victim.
He allegedly said he had grabbed the victim because he was being “unruly.”
The victim’s mother allegedly confirmed that Majaski wrapped his arms around the victim’s neck and squeezed. The victim’s mother said she separated the two, and the victim was crying but did not appear to be gasping for breath.
She said she didn’t notice marks on the victim’s neck immediately, but did notice them the next morning.
Majaski’s criminal history shows a previous conviction for fifth-degree assault in September 2010.
If convicted, Majaski faces up to three years in prison and/or $5,000 in fines for the felony, and up to one year in jail and/or $3,000 in fines for each gross misdemeanor.
