Derrick James Miner, 27, Deerwood, has been convicted in Morrison County District Court of a felony for fleeing police in a motor vehicle and a misdemeanor fifth degree assault charge.
The charges stem from a March 14 incident when the Morrison County Sheriff’s Department received a report of domestic assault.
The victim told officers Miner punched him in the head and put him in a headlock to the point that he couldn’t breathe.
The assault was over a dispute about a cellphone, the victim said.
There was dried blood on the victim’s head where he said Miner had punched him.
After the assault the pair had been driving when the victim noticed officers making another stop. At that point, the victim pulled up behind them and reported the incident.
When officers spoke with Miner, he said the two had been in an altercation.
When the deputy asked Miner to get out of the vehicle, he instead moved over to the driver’s seat, turned on the ignition and attempted to roll up the windows.
When the deputy stopped the windows from rolling up and again ordered Miner to exit the vehicle, Miner stared at the officer and gave no response.
The officer then broke the passenger side window and attempted to open the front passenger side door, but Miner drove off.
Officers then followed Miner between 85 and 90 miles per hour.
At one point, Miner drove through Lastrup at 60 miles per hour.
As Miner was approaching his residence, officers performed a pit maneuver and stopped his vehicle, and placed Miner under arrest.
At the Morrison County Jail, Miner said he had been in an altercation with the victim and that he had put him in a headlock, but denied putting his arms around the victim’s neck.
Miner pleaded guilty to both charges as part of a plea agreement.
For the felony charge, he was sentenced to 30 days in jail and was given credit for three days served. The judge ordered part of the sentence could be served as work release.
He was also sentenced to three years of supervised probation and was fined $135. For the misdemeanor charge, he was ordered to pay $1,801 in restitution.
