Staples woman convicted of third degree drug possession

Holly Marie Marsh, 39, Staples was convicted May 10 of felony third degree drug possession in Morrison County District Court.

The charge stems from a Feb. 1, 2016 incident, when law enforcement on routine patrol in Motley observed a vehicle, the registered owner of which had a revoked driver’s license.

An officer followed the suspect vehicle and observed that the driver appeared to be making evasive maneuvers, pulling into a gas station briefly before driving away.

The officer initiated a traffic stop, and observed the driver making furtive movements, as if attempting to conceal something.

The driver was identified as Marsh and appeared to be very nervous, with rapid speech, jittery movement and bloodshot eyes indicated she was under the influence of a drug.

Marsh performed field sobriety tests which did not indicate alcohol intoxication. However, Marsh’s pupils were dilated and she exhibited tremors consistent with stimulant use.

Marsh was placed under arrest for driving under the influence. A subsequent search of her vehicle found eight individual baggies containing a substance that field-tested positive for methamphetamine.

The total weight of the substance was 8.8 grams.

Also found in Marsh’s purse were a meth pipe, 3.8 grams of marijuana and a marijuana pipe.

Marsh’s criminal record shows a previous conviction for controlled substance use in August 2015.

Marsh was sentenced to 20 years of supervised probation and was fined $135.

She was also sentenced to 323 days in jail and was given credit for 323 days served.
