Weyaus given stay of adjudication in felony drug case

Jonathan James Weyaus, 20, Cass Lake, was given a stay of adjudication in a felony fifth degree drug possession case, March 2, in Morrison County District Court.

The initial charge stemmed from an incident on the evening of Aug. 26, 2016, when a state trooper was sitting in his vehicle at the Motley Police Department when a vehicle passed by with a cracked windshield.

The trooper followed the vehicle to a gas station and found two passengers inside trying to avoid notice.

When Weyaus opened the door, the trooper allegedly smelled an overwhelming odor of marijuana.

Weyaus’ eyes were dilated and he had marked reddening of the eyes.

The trooper also saw bits of marijuana on Weyaus’ shirt.

The trooper asked Weyaus to move away from the vehicle, but he refused to comply and had to be restrained.

No contraband was found on Weyaus during the search, but when his vehicle was searched, 3.2 grams of marijuana and 1.2 grams of THC were found, as well as a used drug pipe were found.

Weyaus was also charged with a misdemeanor for having over 1.4 grams of marijuana in a vehicle. This charge was dismissed.

Weyaus originally pleaded not guilty to both charges, before pleading guilty to the felony fifth degree possession charge as part of a plea agreement.

Weyaus was sentenced to five years of supervised probation and was fined $50.
