Colten Michael Burton, 24, Motley was charged with fifth degree drug possession, June 13.
On June 11, a member of the Motley Police Department received a report from another member of the department that a vehicle parked at a local business was registered to a person with a warrant out for their arrest.
Law enforcement arrived and placed the registered owner of the vehicle under arrest and searched the vehicle.
During the search, they allegedly found a glass pipe with white, powdery residue under the driver’s seat.
When law enforcement asked the passengers who the pipe belonged to, the criminal complaint said Burton said it was his, it would test positive for methamphetamine and he had been using shortly before the traffic stop.
Burton was placed under arrest. He was previously convicted of fifth degree drug possession back in 2013.
According to the criminal complaint, the pipe tested positive for methamphetamine.
If convicted, Burton faces up to 10 years in prison and/or a $20,000 fine.
