Tony Allan Maciej, who has served on the Swanville City Council since January 2015, pleaded guilty Tuesday to one gross misdemeanor count of domestic assault for striking his girlfriend, Jan. 13.
Maciej admitted that he had been drinking during the incident, and got into an argument with his girlfriend when he lost his temper and struck her, allegedly with an open hand.
According to the criminal complaint, the victim had a black eye as a result of Maciej’s actions. Maciej allegedly denied that the argument was physical when contacted by law enforcement on the evening of the incident.
Maciej’s criminal record shows a previous conviction for second-degree assault from February 2007 in Morrison County, as well as a conviction from domestic assault in Todd County from July 2002.
Maciej was sentenced to 365 days in jail, of which 335 days will be stayed for two years, with credit for two days already served.
Maciej was also sentenced to two years supervised probation, ordered to complete a domestic education class and chemical assessment and fined $285. A restitution study will be completed within 30 days to determine what, if any, restitution Maciej must pay to the victim.
Maciej declined to comment on the matter.
